TERMS AND CONDITIONS OF SALE (June 2026 version)

(hereinafter referred to as "the Seller")
And any person making a purchase (hereinafter referred to as "the Client").
2. Purpose
These Terms and Conditions define the rights and obligations of the parties in connection with the sale of natural and laboratory-grown precious stones, fine stones, gems and associated creations offered by Gemsflower. Any order implies full and unreserved acceptance of these Terms and Conditions.
3. Products
Gemsflower offers natural and laboratory-grown precious stones, as well as fine stones, gems and associated products. As each stone is unique, natural variations may occur (colour, inclusions, size, weight). These variations are part of the product's authenticity and in no way constitute a defect. Laboratory-grown stones display visual characteristics similar to natural stones while being produced through a controlled manufacturing process. Photographs are provided for illustrative purposes only and are not contractually binding. Owing to the nature of the stones and to variations in lighting or screen display, differences in colour or appearance may exist between the images and the actual product. Such variations are normal and do not constitute a defect.
4. Prices
Prices are stated in Swiss francs (CHF). VAT is charged at the applicable statutory rate. Gemsflower reserves the right to change its prices at any time. Products are nonetheless invoiced on the basis of the rate in force at the time the order is placed. Delivery charges are clearly indicated when the order is validated, before payment is confirmed. Any customs duties, import taxes or charges relating to the country of destination are borne exclusively by the Client, in accordance with the regulations applicable in their country.
5. Orders
An order becomes firm and final after :
• Validation of the basket
• Acceptance of these Terms and Conditions
• Confirmation of payment
Gemsflower reserves the right to refuse any order in the event of fraud, dispute or unavailability of a product.
6. Payment
Payment is due immediately upon ordering.
Accepted methods :
• Bank card
• Bank transfer
• PayPal
• Other methods indicated on the site
7. Delivery
Deliveries are made to the address provided by the Client. Delivery times are given as an indication only and may vary depending on destinations and carriers. Gemsflower cannot be held liable for delays caused by carriers, customs, or circumstances beyond its control.
8. Receipt & inspection
The Client is required to check the condition of the parcel upon receipt. Any irregularity must be reported within 48 hours of delivery.
9. Returns
Gemsflower offers a commercial return period of 5 days following receipt. Mandatory conditions :
• Product unused
• Product unworn
• Product unaltered
• Strictly as-new condition
• Complete and intact original packaging
No product failing to meet these conditions may be refunded. Return costs remain payable by the Client, except where the error is attributable to Gemsflower. Returns are subject to inspection and validation by Gemsflower upon receipt.
10. Bespoke products
Bespoke creations and personalised products are neither returnable nor refundable.
11. Gemmological analysis
Certain products may be accompanied by a gemmological analysis report. This document sets out the essential characteristics of the stone, in particular its nature (natural or laboratory-grown), together with its available technical properties. The natural particularities of stones (inclusions, internal variations, colour nuances) constitute elements of authenticity and not defects.
12. Liability
Gemsflower's liability is limited to the amount of the order, within the limits of applicable statutory provisions. No indirect damages may be claimed (loss of revenue, commercial prejudice, etc.).
13. Personal data
Personal data is collected solely for :
• Order processing
• Client relations
• Legal obligations
It is neither sold nor passed on to third parties.
14. Intellectual property
All content (texts, images, logos, website) is the exclusive property of Gemsflower.
Any reproduction or use without written authorisation is strictly prohibited.
15. Force majeure
Gemsflower cannot be held liable in the event of any occurrence beyond its control preventing performance of the contract (transport, disaster, breakdown, administrative decision, etc.).
16. Governing law
These Terms and Conditions are governed by Swiss law.
17. Place of jurisdiction
In the event of a dispute, the courts of the canton in which Gemsflower has its registered office shall have sole jurisdiction, subject to mandatory statutory provisions.
