TERMS AND CONDITIONS OF SALE (June 2026 version)<\/span><\/span><\/strong><\/em><\/p>

(hereinafter referred to as \"the Seller\")<\/p>

And any person making a purchase (hereinafter referred to as \"the Client\").<\/p>

2. Purpose<\/span><\/h5>

These Terms and Conditions define the rights and obligations of the parties in connection with the sale of natural and laboratory-grown precious stones, fine stones, gems and associated creations offered by Gemsflower.\nAny order implies full and unreserved acceptance of these Terms and Conditions.<\/p>

3. Products<\/span><\/h5>

Gemsflower offers natural and laboratory-grown precious stones, as well as fine stones, gems and associated products. As each stone is unique, natural variations may occur (colour, inclusions, size, weight). These variations are part of the product's authenticity and in no way constitute a defect.\nLaboratory-grown stones display visual characteristics similar to natural stones while being produced through a controlled manufacturing process.\nPhotographs are provided for illustrative purposes only and are not contractually binding.\nOwing to the nature of the stones and to variations in lighting or screen display, differences in colour or appearance may exist between the images and the actual product. Such variations are normal and do not constitute a defect.<\/p>

4. Prices<\/span><\/h5>

Prices are stated in Swiss francs (CHF). VAT is charged at the applicable statutory rate.\nGemsflower reserves the right to change its prices at any time. Products are nonetheless invoiced on the basis of the rate in force at the time the order is placed.\nDelivery charges are clearly indicated when the order is validated, before payment is confirmed.\nAny customs duties, import taxes or charges relating to the country of destination are borne exclusively by the Client, in accordance with the regulations applicable in their country.<\/p>

5. Orders<\/span><\/h5>

An order becomes firm and final after :<\/p>

\u2022 Acceptance of these Terms and Conditions
\u2022 Confirmation of payment<\/p>

Gemsflower reserves the right to refuse any order in the event of fraud, dispute or unavailability of a product.<\/p>

6. Payment<\/span><\/h5>

Payment is due immediately upon ordering.\nAccepted methods :

\n\u2022 Bank transfer
\n\u2022 PayPal
\n\u2022 Other methods indicated on the site
<\/p>

7. Delivery<\/span><\/h5>

Deliveries are made to the address provided by the Client.\nDelivery times are given as an indication only and may vary depending on destinations and carriers.\nGemsflower cannot be held liable for delays caused by carriers, customs, or circumstances beyond its control.<\/p>

8. Receipt & inspection<\/span><\/h5>

The Client is required to check the condition of the parcel upon receipt.\nAny irregularity must be reported within 48 hours of delivery.<\/p>

9. Returns<\/span><\/h5>

Gemsflower offers a commercial return period of 5 days following receipt.\nMandatory conditions :<\/p>

\n\u2022 Product unworn
\n\u2022 Product unaltered
\n\u2022 Strictly as-new condition
\n\u2022 Complete and intact original packaging
<\/p>

No product failing to meet these conditions may be refunded.\nReturn costs remain payable by the Client, except where the error is attributable to Gemsflower.\nReturns are subject to inspection and validation by Gemsflower upon receipt.<\/p>

10. Bespoke products\u00a0<\/span><\/h5>

Bespoke creations and personalised products are neither returnable nor refundable.<\/p>

11. Gemmological analysis<\/span><\/h5>

Certain products may be accompanied by a gemmological analysis report.\nThis document sets out the essential characteristics of the stone, in particular its nature (natural or laboratory-grown), together with its available technical properties.\nThe natural particularities of stones (inclusions, internal variations, colour nuances) constitute elements of authenticity and not defects.<\/p>

12. Liability<\/span><\/h5>

Gemsflower's liability is limited to the amount of the order, within the limits of applicable statutory provisions.\nNo indirect damages may be claimed (loss of revenue, commercial prejudice, etc.).<\/p>

13. Personal data\u00a0<\/span><\/h5>

Personal data is collected solely for :<\/p>

\u2022 Order processing
\n\u2022 Client relations
\n\u2022 Legal obligations
<\/p>

It is neither sold nor passed on to third parties.<\/p>

\u00a014. Intellectual property<\/span><\/h5>

All content (texts, images, logos, website) is the exclusive property of Gemsflower.
Any reproduction or use without written authorisation is strictly prohibited.<\/p>

\u00a015. Force majeure<\/span><\/h5>

Gemsflower cannot be held liable in the event of any occurrence beyond its control preventing performance of the contract (transport, disaster, breakdown, administrative decision, etc.).<\/p>

\u00a016. Governing law<\/span><\/h5>

These Terms and Conditions are governed by Swiss law.<\/p>

17. Place of jurisdiction<\/span><\/h5>
